When you buy an overseas property in Italy, either the seller, a real estate agent, or a lawyer is going to draw up a preliminary contract that must be signed by both parties involved. This contract usually is preceded by the binding ‘buying proposal,’ also called a compromesso. This document ensures that a buyer is legally obligated to purchase the property if chosen for it, but the seller and real estate both are free to take other offers under consideration in the meantime.

The preliminary contract includes all the details of a sale, such as the purchase price of the property and any financing involved with it. It also contains the completion date for the sale, which is normally between six and eight weeks.

Then the sale is completed in front of a public notary whenever the final deed to the property is signed over. There are two different types of deeds in Italy. One is a private deed, the other is a public instrument. You are probably familiar with private deeds, but a public instrument may be new to you. This is simply a document that that offers more protection and also costs slightly more than a private deed. When buying a public instrument, if any charges are found against a bought property, like a mortgage, you can then seek legal recourse against the notary involved for professional misconduct.
